These Terms of Service (“Terms”) govern your use of the HeroPose mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms.
1. Description of Service
HeroPose is a mobile application that uses artificial intelligence to transform photos of people into superhero images. The App offers:
• AI-powered photo transformation using Google’s Gemini AI
• On-device image generation using Apple Intelligence (on supported devices)
• AI-powered dance video generation
• A virtual currency system (“Diamonds”) for accessing premium features
• A weekly subscription plan for enhanced access
2. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you must have permission from a parent or guardian. By using the App, you represent that you meet these age requirements.
3. User Content
Photos You Upload
• You retain ownership of all photos you upload to the App.
• By uploading a photo, you grant us a limited, non-exclusive license to process that photo through our AI services for the sole purpose of generating your superhero transformation.
• You represent that you have the right to use any photo you upload (e.g., it is your own photo or you have consent from the person depicted).
Generated Content
• You own the superhero images and videos generated by the App from your photos.
• You are free to use, share, modify, and distribute your generated content for personal and commercial purposes.
• Generated content may include a “HeroPose” watermark.
Restrictions
You agree not to:
• Upload photos of individuals without their consent
• Use the App to create content that is illegal, harmful, threatening, abusive, or objectionable
• Attempt to bypass the App’s security measures, credit system, or usage limits
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems or bots to access the App
• Resell or redistribute the App or its features
4. Virtual Currency (Diamonds)
How Diamonds Work
Diamonds are a virtual currency used within the App to generate images and videos. Diamonds have no real-world monetary value and cannot be exchanged for cash.

Free Diamonds
• New users receive 30 free Diamonds upon installation.
• Free users may receive up to 10 Diamonds per week (Sundays), subject to a maximum balance of 30.
• During your first week, on-device image generation is free.
Purchased Diamonds
• You may purchase additional Diamonds through in-app purchases.
• Purchased Diamonds never expire and are not affected by subscription status.
• All purchases are processed by Apple. We do not handle payment information.
• Purchased Diamonds are non-refundable except as required by applicable law.
Subscription Diamonds
• Pro subscribers receive 350 Diamonds per week, which refresh on each renewal.
• Unused subscription Diamonds expire at the end of each billing cycle.
• Subscription Diamonds are consumed before purchased Diamonds.
5. Subscriptions
Pro Subscription
Price: $4.99 per week (USD), auto-renewing
Includes: 350 Diamonds/week, all 10 daily heroes unlocked, access to all 100 heroes, free on-device generation, dance video generation
Payment is charged to your Apple ID account at confirmation of purchase.
Auto-Renewal
• Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
Managing Your Subscription
• You can manage or cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions).
• Cancellation takes effect at the end of the current paid period. You retain access to Pro features until the period ends.
Free Trial
• If offered, the free trial period grants temporary Pro access with 150 Diamonds.
• If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
6. Refunds
• Refund requests are handled by Apple in accordance with their refund policies.
• If a refund is granted, subscription Diamonds will be zeroed. Purchased Diamonds are preserved.
• Generated content remains in your gallery regardless of refund status.
7. AI-Generated Content
• AI-generated images and videos are produced by third-party AI services (Google Gemini, xAI).
• We do not guarantee the quality, accuracy, or suitability of any generated content.
• If a generation is blocked by safety filters, your Diamonds will be automatically refunded.
• We reserve the right to restrict access if the App is used to create harmful content.
8. Intellectual Property
• The App, including its design, code, hero characters, and artwork, is owned by us and protected by intellectual property laws.
• All 100 superhero characters in HeroPose are original creations. Any resemblance to existing characters is coincidental.
• You may not copy, modify, or distribute any part of the App except your own generated content.
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT THE RESULTS OF USING THE APP WILL MEET YOUR EXPECTATIONS; OR THAT ANY DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PRECEDING 12 MONTHS.
11. Service Availability
• We reserve the right to modify, suspend, or discontinue the App or any feature at any time without notice.
• Third-party AI services may experience outages or changes that affect the App’s functionality.
12. Changes to These Terms
We may update these Terms from time to time. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the India. Any disputes arising from these Terms shall be resolved in the courts of Bangalore/India.
